Learned advocate on record on behalf of the petitioner submits that there are inherent mistake in the writ petitioner. Accordingly, he may give liberty to sue afresh. Learned advocate on record hand over the original written instruction of the petitioner. Let the written instruction be kept on record.

Having heard the learned counsel for the petitioner as well as in presence of learned counsel appearing on behalf of the State respondent and private respondent; it appears to be prudent to dispose of the same.

Accordingly, the instant writ petition is hereby dismissed and disposed of with a liberty to the

petitioner to sue afresh on the self same cause of action.
