ssd CRR/2120/2015 ABBAS MALLICK & ORS VS STATE OF WEST BENGAL & ANR.
This is an application under Section 482 of the Cr.P.C. read with Section 401 of the Cr.P.C. filed by the petitioner for quashing of a proceeding being G.R. (E) Case No.831 of 2014 in connection with Egra Police Station Case No.405/2014 dated 27.11.2014 under Sections 363A/366A/372/34 of the Indian Penal Code pending before the Additional Chief Judicial Magistrate, Contai, Purba Medinipur. The Hon'ble Court on 9th July, 2015 was pleased to admit the revisional application with a direction to the petitioners to serve a copy of the application upon the opposite parties and also was pleased to grant an order of stay for a period of eight weeks.
On 10.09.2915 such interim order was extended till expiry of two weeks after ensuing Puja Vacation or until further order whichever is earlier. The matter thereafter appeared on March 1, 2016 when the Officer-in-Charge, Egra Police Station was directed to notify the opposite party no.2 as to
the pendency of the proceeding and interim order was extended for a period of four weeks.
On May 6, 2016 the same was further extended for a period of eight weeks and on 9th September, 2016 the learned Advocate appeared on behalf of the petitioners and submitted that the parties have married to each other and residing as husband and wife and a child has also been born from their wedlock.
Since thereafter the matter never appeared in the list.
Today also none appears for the parties and the matter is running in the Warning List since 20.02.2025.
In view of the above, this Court is of the view that there is no need to keep the matter pending and the same stands dismissed for default.
Let a copy of this order be forwarded to the Additional Chief Judicial Magistrate, Contai, Purba Medinipur.
