The affidavit-of-service as filed by the learned Advocate for the writ petitioner is taken on record. 2.

Despite service none appears on behalf of the respondent nos. 2 to 5 that is the Arambagh Municipality and its officials.

However, the State is represented today.

By filing the instant writ petition the writ petitioner alleges illegal construction at the instance of the private respondent no. 8 at Mouza - Parul, J.L. No. 38, Khatian - 175, Dag Nos. 1580 and 1581, Village - Basudebpur, Ward No. 1, P.S. Arambagh, District - Hooghly.

In view of such, while disposing the instant writ petition the respondent no. 3, i.e., the Chairman of the Arambagh Municipality is directed to treat the letter dated 03.06.2024 as written by the writ petitioner as a representation of the writ petitioner and thereafter shall cause an inspection with regard to the allegation as made by the writ petitioner by the respondent no. 4, i.e., the

Executive Engineer, Arambagh Municipality and in the event in such inspection report any illegal construction is noticed at the behest of the private respondent no. 8, the respondent no. 3, i.e., the Chairman of the Arambagh Municipality is hereby directed to issue notice both upon the writ petitioner as well as the private respondent and thereafter hearing them shall pass a reasoned order and shall communicate the same to the writ petitioner as well as to the private respondent forthwith by speed post or by email, if email details of the writ petitioner and the private respondent are provided at the time of hearing to the said Chairman. The entire exercise that is inspection, issuance of notice upon the writ petitioner as well as to the private respondent, hearing them and passing of the reasoned order are to be completed positively within last day of 2024.

It is made clear that the time limit as made by this Court is peremptory and mandatory.

With the aforementioned observations, the instant writ petition being WPA 17140 of 2024 is hereby disposed of.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
