Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner is aggrieved by the fact that in spite of judgement and decree passed in T.S. No. 100 of 2017, the police authorities are not allowing the petitioner to cultivate.

Learned senior advocate appearing for the respondent no.5 denies and disputes the contention so far as the civil court's decree is concerned which according to him, is an ex parte decree.

State has submitted a report which reflects that no communication was made to Nayagram Police Station.

Having regard to the fact that the police authorities have been unnecessarily roped in and no information was furnished before the police authorities, I am of the view that the petitioner

would inform the police authorities, if he has orders. Police authorities would exercise their discretion as they deem fit and proper.

With the aforesaid observations, the writ petition being WPA 16106 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
