Vs.

The State of W.B. & Ors.

Mr. Luftul Haque Gazi Faruque Hossain Ms. Priyanka Mondal Ms. T. Khatun ...for the petitioners.

Mr. Chandi Charan De Mr. Anirban Sarkar ...for the State.

Affidavit of service filed by the petitioners is taken on record.

Heard learned counsels for the parties.

It is contended on behalf of the petitioners that their land was acquired by the State respondents but no compensation has been granted to them for the same. The petitioners seek compensation under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The petitioners submitted a representation before the concerned authority in this regard on 13th February, 2023, which is yet to be considered. The petitioners pray for a direction upon the concerned authority to consider the representation at the earliest.

Learned counsel for the respondents denies and disputes the contention of the petitioners and submits that the 3rd respondent be directed to consider the

representation submitted by the petitioner, in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the representation submitted by the petitioners dated 13th February, 2023 within two months from the date of communication of this order, upon affording reasonable opportunity of hearing to all concerned, including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
