The petitioner's mother died-in-harness as an Anganwadi Worker (AWW) working at Bhagwanpur- I, ICDS Project. She died on January 29, 2022 at the age of 64 years. The petitioner's prayer for compassionate appointment was made on February 8, 2022. The CDPO requested the District Programme Officer (DPO), ICDS, Tamluk, Purba Medinipur vide office Memo dated December 1, 2022 to consider the petitioner's prayer for engagement on compassionate ground. He also requested an early action by the DPO.

Mr. Das, learned counsel appears on behalf of the petitioner.

Mr. Roy Mukherjee, learned counsel appears on behalf of the State-respondents.

Considering the rival submissions of the parties and the materials placed on record, this Court directs the District Programme Officer/ the respondent No. 2 to take a reasoned decision on the representation dated February 8, 2022, filed on behalf of the petitioner. The DPO will also take into consideration the representation of the CDPO dated December 1, 2022 while disposing of the representation of the petitioner.

The petitioner shall be given a personal hearing within 8(eight) weeks from date. A reasoned order shall be passed and communicated to the petitioner within 2 (two) weeks of passing thereof.

With the directions aforesaid, WPA 16247 of 2023 is disposed of.

Since no affidavits have been called for in the writ petition, the allegations contained therein be deemed not to have been admitted by the respondents.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
