Sen .....for the appellant Mr. Indranil Chakraborty Mr. Suryasarathi Basu .....for the respondent No. 1 Learned senior counsel appearing for the appellant-state submitted that first respondent died without leaving any legal heirs and in view of the death of the first respondent, this appeal has become infructuous.

Learned counsel appearing for the appellants prayed that appellants may be permitted to raise all the grounds now raised in the present appeal in another similar appeal filed in MAT 461 of 2018. Recording the said submissions, the appeal is dismissed as infructuous.

It is open to the appellant to raise all the grounds now raised in the present appeal in other similar matters including MAT 461 of 2018.

With the above observations, the appeal is dismissed without any order as to costs.
