Mr. Dipanjan Chatterjee, Ms. Richa Pramanik ...for the petitioner Mr. Amal Kumar Sen, Mr. Lal Mohan Basu ...for the State Learned counsel appearing for the petitioner submits that the petitioner passed out the LL.B course duly in the year 2013. Subsequently, an application has made with the West Bengal Bar Council in the year 2016 for enrolment as an advocate. However, till date, no response has been given thereto by the Bar Council.
Despite service, none appears for the Bar Council. Affidavit-of-service filed in Court today be kept on record.
It does not appear from the record that any response has been given by the State Bar Counsel to the application of the petitioner for enrolment as
an advocate. There is nothing on record also to show that the Council has any valid objection to such application.
Accordingly, W.P.A. No. 16264 of 2023 is disposed of by directing the respondent no. 2, the Bar Council of West Bengal, to immediately process the application of the petitioner for enrolment as an advocate.
The outcome of such application shall be communicated to the petitioner by the said Council within a month from date.
All parties shall act on a server copy of this order, without insisting upon prior production of a certified copy thereof.
It is made clear that in the event the State Bar Council has any valid legal objection to such enrolment being granted, a communication in that regard shall be made in specific terms to the petitioner and a hearing shall be given to the petitioner on such count before taking a decision on the application of the petitioner.
The entire exercise, it is expected, shall be concluded within an outer limit of one month from date.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
