The present petitioner happens to be one Sk. Kelimolla. Learned advocate appearing for the petitioner submits that he is ready and willing to surrender before the jurisdictional court.

I find that charge-sheet was filed in the year 2019. The last of the order so enclosed is of August, 2021 where there was a direction for execution return of the warrant of arrest which was earlier issued by the learned Chief Judicial Magistrate, Purba Medinipur in seisin of the proceedings.

In view of the undertaking given by the learned advocate appearing for the petitioner and the fact that State has not been able to furnish information regarding the whereabouts of the warrant of arrest, I direct that in case the petitioner surrenders before the learned Chief Judicial Magistrate, Purba Medinipur by 10th November, 2022, learned Magistrate will consider his application for bail in accordance with law.

Let the warrant of arrest so issued by the learned Chief Judicial Magistrate, Purba Medinipur be kept in abeyance till 10th November, 2022.

In case the petitioner does not surrender by 10th November, 2022, the learned Chief Judicial Magistrate, Purba Medinipur will resort to harsher process of law relating to proclamation.

With the aforesaid observations, CRR 2211 of 2021 is disposed of.

Pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
