Heard the learned Advocates appearing for the parties. Petitioner is in custody for over three years. He renews his prayer for bail.

Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record including the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. Date has been fixed for examination of the victim before the trial court.

In view of the aforesaid incriminating material and as the examination of the victim is fixed and trial is delicately poised, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
