1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made an application for transfer on Utsashree Portal on 10th February, 2022. School authority where petitioner is presently working forwarded the transfer application to the concerned District Inspector of Schools (SE) on 9th February, 2022 and District Inspector of Schools (SE) in his turn processed the transfer application and forwarded the same through portal to the West Bengal Central School Service Commission for taking decision. Grievance of the petitioner is till date transfer application is not decided.

3. Respondents are represented by learned advocates who have submitted perhaps due to suspension of portal with effect from 29th September, 2022 transfer application was not contemporaneously decided. However, it is submitted on behalf of the Commission if concerned authority is directed transfer application shall be decided in accordance with law.

4. Having considered the submissions made on behalf of the parties writ petition is disposed of directing Secretary, West Bengal Central School Service Commission to decide the transfer application of the petitioner by 6 weeks from the date of communication of this order.

5. The decision to be taken by the Secretary shall be communicated to the petitioner by fortnight thereafter.

6. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

7. Leave is granted to the learned advocate for the petitioner to amend the cause title in course of this day and add Secretary, West Bengal Central School Service Commission as additional respondent.

8. However, service of notice upon additional respondent stands dispensed with since Commission is represented by learned advocate.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
