Despite service, none appears on behalf of the private respondents, although the petitionerbank and the State are represented through counsel.

The grievance of the petitioner-bank is that despite having applied under Section 14 of the Securitisation And Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act, 2002) as long back as on February 8, 2022, the matter is not being proceeded with by the respondent no. 2, that is, the District Magistrate, Hooghly.

Since, within the contemplation of the relevant Statute, such matters are required to be disposed of expeditiously, WPA No. 16258 of 2023 is disposed of by directing the respondent no. 2, that is, the District Magistrate, Hooghly, to dispose of the application under Section 14 of the SARFAESI Act of 2002 filed by the petitionerbank on February 8, 2022 (Annexure P3 at page 21 of the writ petition) as expeditiously as possible, positively within a fortnight from the date of communication of this order to the said respondent.

There will be no order as to costs.

The parties shall act on a server copy of this order, without insisting upon prior production of a certified copy thereof.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
