The application under Section 439 of the Code of Criminal Procedure is moved by the learned Advocate for the petitioner praying for his bail seeking parity with co-accused who had granted bail in CRM 6620 of 2021 by a coordinate Bench of this Court on October 4, 2021. It is submitted that intermediate quantity of contraband substance was seized from the joint possession of the petitioner along with co-accused persons who have already been granted bail in this case. Learned Advocate for the State raises no objection. Perused the case record and the earlier order dated October 4, 2021 passed in CRM 6620 of 2021.

In view of the earlier order as well as the nature of the case, prayer for bail of the accused petitioner is allowed. The petitioner shall be released on furnishing a bond of Rs.10,000/- (Rupees ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Judge, NDPS Court (ADJ, 5th Court, Berhampore, Murshidabad) subject

the petitioner shall appear before the learned Trial Court on every date of hearing till further order and shall not intimidate the witnesses or tamper with evidence in connection with this case.

The prayer for bail is allowed. CRM 6950 of 2021 is disposed of.
