The instant criminal revision is based on the service condition between the employer and the employee whereby the employee was asked to return certain amount of money to the employer on completion of his tenure of employment which denotes a civil dispute between the parties.

Under such circumstances, Complaint case being C-6951 of 2009 under section 406 IPC pending before the learned Judicial Magistrate, 5th Court, Alipore, 24 Parganas (South) is quashed. Interim order, if any, stands vacated.

In view of above, CRR 2705 of 2011 is disposed of. (Ananya Bandyopadhyay, J.)
