For the Petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ......For the State This is the second instance of application for bail filed on behalf of the petitioner under Section 439 of the Code of Criminal Procedure in connection with Bongaon Police Station Case No.965 of 2019 dated 08.12.2019 corresponding to Special Case No. N 243 of 2019 under Section 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act.

It is submitted on behalf of the petitioner that the petitioner is in custody for 664 days and left in limbo without any trial.

Learned counsel for the State submits that charge-sheet has already been submitted and charge has been framed in connection with this case and two of the prosecution witnesses have already been examined and the trial is in progress. The question which has been raised by the learned advocate appearing for the petitioner, at this stage, can be dealt with by the Trial Court. We have heard learned counsel appearing for both the parties and considering the commercial quantity of contraband having been seized, prima facie, from the possession of the petitioner, the prayer for bail is considered and rejected. Thus, the application being, CRM 6963 of 2021 is disposed of. The learned trial court is requested to undertake the trial as expeditiously as possible.
