This is an application under Section 5 of the Limitation Act wherein the petitioners have prayed for condonation of delay in preferring the present application for restoration of the application being CRR 2345 of 2004.

Having considered the grounds shown in paragraph 5 of the application, the prayer for condonation of delay in filing the application is allowed.

CRAN 2 of 2025 is accordingly disposed of.

Re: CRAN 1 of 2021 Affidavit of service filed by the petitioners is taken on record. This is an application wherein the petitioners have prayed for restoration after recalling the order dated 12th July, 2019 passed by this court. By the said order, this court was pleased to dismiss the application on the ground of default.

Having heard the learned counsels for the petitioners and the State and also considering the weighty consideration that the matter should be disposed of on merit after hearing of both the parties, the prayer for restoration is allowed. Let CRR 2345 of 2004 be restored in its original file with original number.

CRAN 1 of 2021 is accordingly disposed of.
