03.11.2021 Court No.8 Item No.15 AP/ss (Rejected) CRM 6975 of 2021 (Through Video Conference) In the matter of : An application for bail under section 439 of the Code of Criminal Procedure in connection with Kandi P.S. Case No.320 of 2019 dated 06.08.2019 under Sections 302/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act.

And In the matter of : Sentu Sk. @ Mahatadin Sk. and Anr. Ms. Minoti Gomes, Mr. Hafiz Ali, Mr. Kausik Biswas ... ... for the petitioners Mr. Binay Panda Ms. Puspita Saha ... ... for the State The petitioners have been included as accused in course of trial in terms of an order passed under Section 319 of the Code of Criminal Procedure. The petitioners surrendered and are in custody for 281 days. Bail is prayed for since the trial is progressing slowly.

It appears from the records that by an order dated 28th September, 2021 in CRM 4577 of 2021 was dismissed. However, a direction was passed on the State to complete the trial within one year. The said one-year expires on 27th September, 2022. Under these circumstances, this Court is of the view that the application for bail is premature. The application for bail being CRM 6975 of 2021 fails and stands rejected.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
