Interim maintenance was granted to the petitioner by the learned Judicial Magistrate, 1st Court, Bidhannagar, North 24 Parganas by an order passed on 8th July, 2022 in M. Case no. 16 of 2020. As the opposite party did not comply with the said order, the petitioner initiated a Misc. Execution case being no.10 of 2024 which is pending.

Learned counsel for the petitioner submits that the warrant of arrest has been issued against the opposite party with no fruitful result. Accumulated arrear maintenance as on this date is Rs.9,75,000/-.

In view of the above, this Court directs the learned Judicial Magistrate, 1st Court, Bidhannagar to exhaust all procedures in securing the attendance of the opposite party before his Court and for implementation of the order dated 8th July, 2022 passed in Misc. case no.16 of 2000, subsequently modified by this Court by an order passed on 23rd April, 2024 in CRR 3017 of 2022 and dispose of the execution case prior to commencement of the ensuing annual vacation.

With the aforesaid directions, CRR 2757 of 2024 is disposed of. Urgent certified website copy of this order, if applied for, be given to the parties, upon compliance of all requisite formalities. (Suvra Ghosh, J.)
