....For the State The learned Advocate for the petitioner submits that his client is in custody for last one year seven months, who has been arrayed in connection with a case of commercial quantity of contraband articles having allegedly been seized from him.

Considering the nature of the offence and the bar as provided under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the prayer for bail of the petitioner is considered but is rejected as the long incarceration in jail is no ground for bail.

However, the learned Judge, Special Court under Narcotic Drugs and Psychotropic Substances Act, 1985 is requested to undertake the trial as expeditiously as possible.

The application for bail, being C.R.M. No. 6986 of 2021, is dismissed.
