It is submitted by the learned Counsel appearing for the petitioner that the petitioner has been falsely implicated in the instant case due to village rivalry.

Learned Counsel appearing for the State opposes the prayer for bail and submits that the victim is a ten year old girl. Statement of the victim recorded under Section 164 of the Code of Criminal Procedure prima facie disclose involvement of the petitioner subjecting her to penetrative sexual assault. In view of gravity of the offence and the vulnerable status of the victim, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
