None appears for the petitioner when the matter is taken up for hearing. No accommodation is prayed for.

The notice dated 5th August, 2022 issued by the Medical Superintendent-cum-Vice Principal of the SSKM Hospital, Kolkata is taken on record.

It is submitted by Mr. Basu Mallick, Counsel for the State that as per the contents of the abovementioned notice SSKM have constituted a Medical Board to assess the physical condition and percentage of disability of the petitioner pursuant to the order of this Court dated 20.07.2022. It is further submitted by him that the petitioner has chosen not to appear before the Medical Board despite repeated intimations.

This Court is, therefore, of the view that the petitioner may not be willing to get himself physically assessed to ascertain the existence, if any, of the disabilities alleged by him.

In that view of the matter, the instant writ petition shall stand dismissed.

There will be no order as to costs.
