Since the innocuous prayer of the petitioners is for expeditious disposal of the case being S.T. case no. 354 of 2012 pending before the learned Additional Sessions Judge, 4th Court, Howrah the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case.

It appears that the case is pending since 2012. This Court is informed that eighteen witnesses have already been examined and only two witnesses are left to be examined by the State, the said witnesses being the Investigating Officer of the case and the scribe. In an earlier order passed by this Court on 24th April, 2024 in CRR 1431 of 2021, this Court directed the trial Court to continue with the evidence of the case and make all efforts so that examination of the accused under Section 313 of the Code of Criminal Procedure was concluded by 15th June, 2024.

It appears that the said order has not been complied with by the learned trial Court.

In view of the above, the learned Trial is directed to dispose of the matter pending before him within one year from the next date fixed before him, without granting any unnecessary adjournment to either

of the parties, in accordance with law. Trial of the case shall continue irrespective of any resolution taken by the local Bar. CRR 2760 of 2024 is disposed of.
