16-07-2024 (ct. no.28) KOLE CRM (NDPS) 1076 of 2024 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ashoknagar Police Station Case No. 23 of 2009 dated 19.01.2009 under Section 21 of NDPS Act. - A n d - In the matter of : Mr. Khokan Mondal @ Mona .... Petitioner.

Mr. Debangan Bhattacharjee, Mr. S. Saha, Ms. S. Rabidas, ... For the Petitioner.

Mr. Sandip Chakraborty, Mr. S. Saha, ... For the State.

Order dictated in open court by Apurba Sinha Ray, J.: Learned Counsel for the petitioner says that the petitioner is in custody for about 68 days. Earlier he was granted bail but due to predicament he could not appear before the learned Trial Court and as such warrant of arrest was issued against him and since then he is in custody.

Learned Advocate for the State vehemently opposes the prayer for bail. According to him, the petitioner has absconded for nearly 14 years after obtaining bail from this Court and as such his prayer for bail should be rejected.

We have considered the materials on record and it appears that the petitioner had absconded for nearly about 14 years after he was granted bail from this Court. If we release the petitioner on bail at this stage, there is every possibility that he may again abscond.

On an overall assessment of the case, we are not inclined to allow the petitioner's prayer for bail, at this stage. CRM (NDPS) 1076 of 2024 is, thus, dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Apurba Sinha Ray, J. ) ( Arijit Banerjee, J. )
