1. Learned counsel for the petitioner contends that despite the specific direction dated June 09, 2022 passed in WPA 5285 of 2021 on the West Bengal State Electricity Distribution Company Limited (WBSEDCL) to give an electricity supply to the petitioner for running her submersible pump, the said connection was not given to the petitioner on the ground that the petitioner has not provided any SWID certificate.

2. Learned counsel appearing for the WBSEDCL submits that a SWID certificate is required for getting electricity connection in the area, since the same has been marked as a 'critical zone'.

A perusal of the order dated June 09, 2022 shows that although an unqualified direction was given to the WBSEDCL to give new electricity connection to the petitioner, it is implicit in the said direction that such connection is subject to the petitioner otherwise complying with all formalities and entitled to the connection in law.

4. Since the only sticking point to give the connection to the petitioner now is the production of a SWID certificate by the petitioner, the petitioner is directed to produce a SWID certificate for the purpose of compliance of the order dated June 09, 2022.

5. However, insofar as the contempt application is concerned, no case of deliberate violation of the order of this court has been made out as such.

6. Accordingly, CPAN 942 of 2023 is disposed of by granting liberty to the petitioner to produce a SWID certificate for getting the petitioner's connection.

7. If so produced, the respondent-authorities shall comply with the order passed by this court on June 09, 2022 in WPA 5285 of 2021 by giving electricity connection to the petitioner, subject to compliance of all formalities by the petitioner.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
