On perusal of the said report it appears that in three vacancies in three different schools as named in paragraph 5 of the said report there is no scope left open for the petitioner to be transferred. In this regard statements are made in paragraph 9 disclosing that out of three schools in two schools the posts which were opted by the petitioner are already filled up by transfer on joining the first selected candidates. In another school there was no availability of vacancy which prompted the candidate who was recommended for transfer to seek re-recommendation.

In view of aforesaid position the scope of the petitioner to be transferred to one of the three posts as indicated in paragraph 5 of the report is not available. In view of aforesaid situation no further order need be passed and the writ petition stands disposed of granting leave to the petitioner to take steps in accordance with law in future for his transfer.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
