It is submitted by the learned Counsel appearing for the petitioner that the petitioner has been falsely implicated in the instant case.

Learned Counsel appearing for the State opposes the prayer for bail.

We have considered the materials on record particularly the statement of a neighbour recorded under Section 164 of the Code of Criminal Procedure implicating the petitioner in the instant case. Dead body of the deceased housewife was recovered from her matrimonial home and no explanation regarding her homicidal death is forthcoming from the petitioner.

In view of the aforesaid facts an circumstances of the case and the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.

And In Re : Rabish Kumar Upadhyay ..... petitioner Mr. Asraf Ali ... for the petitioner Mr. Debojyoti Deb ... for the State Having considered the materials on record prima facie disclosing involvement of the petitioner in the alleged crime of misappropriation of monies of the innocent depositors and the fact that the petitioner has absconded for a protracted period of time, we are not inclined to grant bail to the petitioner at this stage.
