Learned advocate for the petitioner is directed to serve a copy of the revisional application upon Mrs. Sujata Das, learned Additional Public Prosecutor, who ordinarily appears before this court on behalf of the State. Her appearance may be regularized by the concerned Authorities in due course.
Learned advocate for the petitioner has drawn the attention of this court to the first information report, chargesheet and the documents under Section 207 of the Code of Criminal Procedure. I have considered the materials available and also the stage at which the petitioner has approached this court. It has been informed that the next date has been fixed for consideration of charges. If the petitioner takes out an application in the nature of
Section 239 of the Code of Criminal Procedure, the learned Magistrate in seisin of the matter would consider the same in accordance with law without being influenced by any observations made by this court while disposing of the revisional application. With the aforesaid observations, the revisional application being CRR 2527 of 2023 is disposed of.
