Mr. Farooque Ali .........for the petitioner Mr. Susanta Pal Ms. Kakali Samajpati ..........for the State The grievance of the petitioner is that the petitioner as an employee of the Calcutta Blind School, which is an aided institution, is not getting parity of pay as compare to the other institutions following the Government Memo dated 23rd July, 2001.

Counsel submits that several representations were made to the concerned respondents. The last of such is of dated 7th May, 2019. But the respondents have not replied to the said representations.

Learned counsel appearing for the State objects to the prayer of pay parity and relies upon certain other notifications to that respect.

Upon hearing learned counsel for the parties, this Court is of the view that the objection

of the State-respondents may be taken by way of a reasoned order which should be passed upon hearing all concerned parties including the petitioner within four weeks from date. A copy of such reasoned decision shall be made available to the petitioner within four days from the date on which such reasoned decision is taken.

It is made clear that if the petitioner is found to be eligible for pay parity under the relevant notification, the petitioner's prayer for the same should be considered by the concerned respondents without any further delay.

WPA 15438 of 2019 is disposed of accordingly.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
