17-09-2025 Item No.26 Subrata Bhattacharyya IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side AR(C) WPA No.16457 of 2025 Amrita Acharyya -vsLife Insurance Corporation of India & Ors. Mr. Subhadip Biswas ...for the petitioner Mr. D.K. Kundu Mr. Arjun Basu ...for LIC Mr. Kunal Ganguly Mr. Tirupati Mukherjee ...for private respondent 1.

The petitioner lodged a complaint against the private respondent who is an employee of Life Insurance Corporation alleging forgery of her signature. The private respondent was arrested in response to the complaint before the police and has thereafter been released on bail.

2.

Challenging slow progress of the investigation by the police, the petitioner approached this Court by filing WPA NO.10131 of 2025 which stood disposed of on May 16, 2025 with the observation that efforts would be taken by the police so that the investigation could be reached to its logical conclusion within a reasonable period of time. 3.

In the instant writ petition, the petitioner prays for a direction upon LIC to restrain the private respondent from getting access to the materials and documents of the petitioner. Prayer has also been made for a direction upon LIC to initiate disciplinary proceeding against the private

respondent.

4.

Learned counsel for LIC submits, upon instruction that, an internal investigation was conducted and the allegation against the private respondent could not be substantiated.

5.

Learned counsel for the private respondent denies the allegation of the petitioner. Both the respondents submit that the writ petition is not maintainable.

6.

After hearing the parties and on perusal of the materials on record, it appears that the allegation of the petitioner is that the employer has failed to take necessary action against the employee against whom complaint was made by the petitioner. Whether the employer will initiate any disciplinary proceeding against the employee is absolutely the domain of the employer and it will not be proper for the writ Court to pass any order mandating the employer to initiate disciplinary proceeding against the employee.

7.

The police are already investigating the complaint lodged by the petitioner. The Court has directed the police to conclude the investigation within a reasonable period of time. No further relief can be granted to the petitioner.

8.

The writ petition is disposed of.

9.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

10.

Certified copy of this order, if applied for, shall be made available to the parties.
