The petitioner seeks benefit of the order No. 261/2 (Edn.)(P)/4A-3/80 dated 7th April, 1981 by the Education Department, Primary Branch counting past services of the teachers in Primary Schools serving in recognized Secondary Schools towards pensionary benefits under the Recognized Non-Government Secondary Institutions Pension Rules.

The petitioner applied for consideration of his prayer but the same is pending consideration. Without entering into the merit of the prayer of the petitioner, the instant writ petition is disposed of by directing the respondent nos. 8 and 9 to forward the cause papers of the petitioner to the District Inspector of Schools (S.E.), Bankura within four weeks from the date of communication of this order. The District

Inspector of Schools will consider and dispose of the prayer of the petitioner for availing the benefit of the aforesaid Government Order at the earliest but positively within a period of eight weeks from the date of receipt of all papers from the Council. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate appearing on behalf of the petitioner is directed to forward a copy of his representation to the respondent nos. 8 and 9 along with the relevant Government Order at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
