Affidavit-of-service filed by the petitioner be kept with the record.

Learned advocate for the petitioner is aggrieved regarding the progress of Shyampukur P.S. Case No.13 dated 14.02.2025 and submits that in spite of investigation having commenced, there has been no progress in the investigation.

The investigation of the case as submitted by the learned advocate for the State is still in progress. Accordingly, State would submit a progress report since 90 days is over to the de facto complainant of the case. The said progress report be handed over to the petitioner within 72 hours. If the petitioner is aggrieved regarding the progress of the investigation,

petitioner would canvass the issue in respect of which he is aggrieved before the learned special court which is in seisin of Shyampukur P.S. Case No.13 dated 14.02.2025.

Learned advocate appearing for the private respondents submits that one of the accused person is on bail. So far as the other accused is concerned, he would approach the court of law.

Be that as it may, since the police authorities are directed to comply with the directions passed above, further pendency of the writ petition is unwarranted as the petitioner has been granted liberty to approach the learned special court which is in seisin of the case.

With the aforesaid observations, WPA 16210 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
