rkd 17.02.2022 Ct. No.29 C.R.M. 7067 of 2021 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 27/10/2021 in connection with Sinthee P.S. Case No. 126 of 2018 dated 02/10/2018 under Sections 170/395/397/34/120B of the Indian Penal Code. And In the matter of: - Biplab Das @ Bapan ....petitioner.

Mr. Arindam Jana, Mr. Rameswar Sinha ...for the petitioner.

Mr. Swapan Kumar Banerjee, Ms. Purnima Ghosh ...for the State.

Petitioner renews the prayer for bail.

Learned advocate appearing for the State submits a report with regard to progress of the trial which is taken on record. It appears from the report that the evidence of one Amal Suryavanshi was expunged. The next date fixed is on March 22, 2022 for further deposition of Jiyarul Sardar. Learned advocate appearing for the petitioner submits that another co-accused who received money, was granted bail by the jurisdictional court. He submits that the prayer for bail of the petitioner was rejected on the ground that the High Court rejected his prayer for bail.

Learned advocate appearing for the State submits that the petitioner cannot claim parity with the other co-accuseds who were granted bail by the jurisdictional court. In the facts and circumstances of the present case and

considering the gravity of the offence and the involvement of the petitioner therein and considering the fact that there is hardly any change in circumstances subsequent to the earlier order of rejection, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

CRM 7067 of 2021 is dismissed.

However, at the request of the learned advocate appearing for the petitioner, we deem it appropriate that the trial should be disposed of expeditiously. The jurisdictional court is requested to dispose of the matter as expeditiously as possible without affording any unnecessary adjournments to any of the parties. (Bibhas Ranjan De, J.)
