CRA (DB) 133 of 2022 is first in point of time. In a similar circumstances, a coordinate Bench by an order dated May 17, 2017 passed in CRA 380 of 2014, CRAN 887 of 2017 with CRA 450 of 2012 [in re:- Sk. Kurban ...... ... Appellant] observed that, the appellant is not entitled to file multiple appeals since the first appeal was admitted. All appeals filed subsequent to the first appeal were directed to be dismissed.
In the facts of the present case, CRA(DB) 133 of 2022 is earlier in point of time and was admitted on July 18, 2022. Subsequent thereto, the same appellant preferred another appeal being CRA (DB) 141 of 2022 which was admitted on July 29, 2022.
The appellant engaged the department of this Hon'ble Court including the Court and expended valuable time of the
Court as well as the department in processing the second appeal. This conduct of the appellant needs to be visited with consequences.
From the cause title, it appears that appellant is a resident of Paschim Medinipur. The District Magistrate, Paschim Medinipur is requested to submit a report as to the assets available to the appellant and his source of income. Let such report be submitted on December 13, 2022. Learned Public Prosecutor is requested to communicate this order to the District Magistrate, Paschim Medinipur for compliance.
The department will treat CRA (DB) 141 of 2022 as dismissed.
