1. The petitioner is a retired member of the Border Security Force. He has made a representation before the Commandant of his battalion seeking direction for calculation of his entitlement of his Earned Leave.

2. The said representation is pending consideration.

3. Learned advocate for the petitioner relies upon the Border Security Force Leave Rules, 1971 in support of his claim.

4. As it appears that the prayer of the petitioner is pending consideration before the Commandant, accordingly, the instant writ petition stands disposed of by directing the Commandant, 27 Battalion, Border Security Force being the respondent no. 4 to take a decision on the petitioner's prayer strictly in accordance with law at

the earliest but positively within a period of eight weeks from the date of communication of this order.

5. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

6. If any amount is found due and payable, the same shall be paid to the petitioner without any further delay.

7. Learned advocate for the petitioner is directed to forward a copy of the representation dated 19th May, 2025 along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court.

8. The writ petition stands disposed of.

9. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
