Heard the learned Advocates appearing for the parties. Petitioner is in custody for over 400 days. It is submitted trial has not commenced.

Learned Additional Public Prosecutor opposes the prayer for bail. He submits there is ample evidence connecting the petitioner with the alleged murder. Delay was due to nonproduction of petitioner from the correctional home. We have considered the materials on record. Delay in the case was due to non-production of petitioner from correctional home. There are ample materials connecting the petitioner with the alleged crime.

Under such circumstances and in view of gravity of offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
