The writ petition is taken up for consideration when the situation which was subsisting previously remains unaltered. It appears from order dated 16th January, 2018 passed by a coordinate Bench that the sole petitioner died during pendency of the writ petition and till date as it emanates from the statement made by the learned advocate representing the petitioner no steps have been taken for substitution.

Howrah Municipal Corporation is represented by learned advocate.

In view of aforesaid situation, it appears that the writ proceeding has been abated.

Accordingly, the writ petition stands dismissed. There shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
