Adv., Ms. Baisakhi Chatterjee ...for the State This is an application wherein petitioner has prayed for expeditious disposal of proceeding being A.C.G.R. Case No.5062 of 2014 presently pending before learned Judicial Magistrate, 4th Court, Alipore. Learned Counsel for the petitioner submits that the case was initiated on 4th August, 2014 and after completion of investigation police submitted charge-sheet on 21st February, 2015. The Court below took cognizance of the offence on 29.04.2025 and the charge was framed against the accused person under Sections 498A/406/34 IPC on 13.09.2023.

It is further alleged that since then the Court below has not yet recorded evidence of any of the prosecution witnesses and the matter is lingering for no fault of the petitioner and, therefore, he prayed for a direction upon the Court below for expeditious disposal of the proceeding. Having heard learned Counsel for the petitioner and the State, I find that the prayer made by the petitioner is justified and required to be allowed for securing the ends of justice specifically in view of the fact that the matter is pending since long.

In such view of the matter, the instant application being CRR 3136 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid proceeding being ACGR Case No.5062 of 2014 and to make best endeavour to conclude the entire proceeding without granting unnecessary adjournment to either of the parties preferably within a period of six months from the next date of hearing. This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
