Apprehending arrest in connection with Narkeldanga Police Station Case No. 84 of 2020 dated 16.03.2020 under Sections 498(A)/406 of the Indian Penal Code, 1860, the present application has been preferred.
Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears from the records that the alleged incident occurred about five years after the marriage. Prima facie, the allegations are omnibus in nature. In view thereof, we are of the opinion that custodial interrogation of the petitioners is not warranted in the facts and circumstances of the case.
Accordingly, we allow this application and direct that in the event of arrest the petitioners, namely, 1. Salman Khan @ Md. Salman @ Md. Salman Khan, 2. Harun Khan @ Harun,
3. Rajba Begam @ Rajma Begam, 4. Runa Laila Khatun @ Mona Begam and 5. Safiya Begam @ Supiya Begam, shall be released on bail upon furnishing a bond of `10,000/- each with
two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 with a further condition that the petitioner nos.1 and 2 shall meet with the investigating officer once a fortnight on and from 6th December, 2021 till the investigation is over.
The application for anticipatory bail, being CRM No. 7108 of 2021, is, thus, disposed of.
