This is an application praying for quashing of a proceeding being GR Case No.442 of 2025 pending before the learned Chief Judicial Magistrate, Calcutta, arising out of Park Street Police Station Case No.80 dated 08.05.2025 under Sections 336(2)/338/340(2)/341(1)/339/61(2) of the BNS. 2.

Report filed on behalf of the State is taken on record.

Learned counsel appearing on behalf of the accused petitioners submits as follows. The allegation was mainly about reliance on certain receipts of letters before an arbitration proceeding, which were denied and disputed by other side. During pendency of the proceeding, all disputes that had led to the registration of an FIR have been settled and compromised between the private parties. In fact, the arbitration proceeding pending had also been disposed of, accordingly. 4.

Learned counsel appearing on behalf of opposite party no.2/company supports such contentions of the accused petitioners and submits that in view of the settlement arrived at between the private parties of all disputes that had led to the initiation of the impugned proceeding, the same may be quashed on the ground of compromise.

Learned Counsel appearing on behalf of the State relies on the report and the case diary and submits as follows. Subsequently, letters were written by the de facto complainant/company praying for withdrawal of the complaint in question. No charge sheet has been submitted yet.

It appears that a settlement and compromise has been arrived at between the private parties of all disputes that had led to the initiation of the impugned proceeding.

In view of the above and in the interest of justice, I quash the impugned proceeding on the ground of compromise and settlement.

The revisional application and the connected application being CRAN 1 of 2025 are, accordingly, disposed of.

9.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
