The petitioner is in custody for about 100 days. Co accused Rabin Bera has been enlarged on bail by a coordinate bench of this Court.
Learned lawyer for the State opposes the prayer for bail. Having considered the materials on record keeping in mind the extent of complicity of the petitioner in the alleged crime and as the co accused, Rabin Bera, who is similarly circumstanced with the petitioner, has been enlarged on bail by this Court, we are inclined to extend the same relief to the petitioner on principles of parity.
Accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner be released on bail upon furnishing a bond of Rs. 10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Arambagh, Hooghly subject to the condition that the petitioner shall appear before the learned trial court regularly on every date of hearing and shall not leave the jurisdiction of the concerned police station and shall report to the Officer-in-charge of the concerned police station once in a fortnight until further orders and the petitioner
shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fail to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without any further reference to this Court. The application for bail is, thus, disposed of. (Aniruddha Roy, J.) (Joymalya Bagchi, J.)
