We have considered the materials on record. On the leading statement of the petitioner narcotics above commercial quantity i.e. 310 grams of Heroin was recovered from a place adjacent to the house of the brother of the petitioner. In view of the aforesaid circumstances and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
