Learned advocate appearing for the petitioner submits that the petitioner is in custody for 230 days in connection with the present case. Petitioner is a driver of Maruti Omni vehicle who was arrested and has been detained for seizure of 1200 bottles of phensedyl. Learned advocate submits that there were two persons who intended to use and ply the car for which an agent was engaged and the agent referred in respect of the said two persons along with their baggages. The said agent has been made as a witness as is reflected from the charge-sheet. Learned advocate appearing for the State opposes the prayer for bail and submits that the seizure list would reflect the name of the present petitioner and there are materials appearing against him.

I have considered the period of detention of the petitioner as also the statement of CSW11, on consideration of

the same, prima facie, I am of the view that the petitioner has been able to overcome the rigors of Section 37 of the NDPS Act. Accordingly the prayer for bail of the petitioner is allowed. As such the petitioner namely, Mofijul Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, 3rd Special Court under NDPS Act, Burdwan. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Purba Bardhaman without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 909 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.
