The petitioner is a retired Assistant Teacher of a secondary school, he is praying condonation of the shortfall of the qualifying service of five months eight days to get the benefit of pension.

The Secretary, School Education Department is directed to consider the said prayer of the petitioner in accordance with law treating the instant writ petition as his representation. Copy of the representation be served upon the said authority in course of this week.

Since no affidavit-in-opposition is invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

W.P.A. 16375 of 2023 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
