The present application under Section 439 of the code of Criminal Procedure has been preferred by the petitioner in connection with Khandaghosh P.S. Case No. 279 of 2014 dated 14.11.2014 under Section 135(1)(a) of the Indian Electricity Act, 2003.
The application for bail relates to offence under Section 135(1)(a) of the Indian Electricity Act, 2003. Ordersheets reflect that the petitioner was lastly represented on 24.08.2015. The subsequent orders dated 25.08.2015 and 20.11.2019 do not reflect the appearance of the petitioner or representation of the petitioner before this Court. The bail application is pending for about six years and none has pursued the matter before this Court for such long period. The present bail application was preferred challenging the
order dated 14.11.2014. As such, I am of the view that the present bail application has become infructuous by efflux of time as the petitioner is not interested to pursue before this Court.
Accordingly, the application for bail, being CRM 6124 of 2015, is dismissed as infructuous.
