Banerjee) Mr. Arijit Bhowmick Ms. Debasree Dhamali Ms. Debasree Mukherjee ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division) 2nd Court at Barasat to dispose of Title Suit No. 754 of 2023 expeditiously.

Learned advocate appearing for the petitioner submits that the application under Order 39 Rule 1 and 2 of the Civil Procedure Code filed by the petitioner herein is still pending and the ad interim order of injunction is being extended from time to time. He further submits that no written objection has yet been filed.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along

with this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge.

From the order-sheets appended to this application this court finds that August 27, 2025 has been fixed for hearing of the application under Section 151 of the Civil Procedure Code and the application under Order 39 Rule 1 and 2 of the Civil Procedure Code.

learned Civil Judge (Sr. Division) 2nd Court at Barasat is requested to take up the hearing of the application under Order 39 Rule 1 and 2 of the Civil Procedure Code on the next date fixed and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

The learned trial judge is further requested to take up the hearing of the application under Section 151 of the Civil Procedure Code in accordance with law.

With the above observations and directions, CO 2608 of 2025 stands disposed of.
