1. The petitioner seeks implementation of the order passed by the Regional Grievance Redressal Officer and Divisional Engineer (Electrical), Paschim Medinipur Region advising the Station Manager to expedite the refund of the temporary security deposit of agricultural connection to the petitioner. More than two years have passed from the date of the said order but the petitioner is yet to receive the refund of the temporary security deposit.
2. Prayer has been made to direct the Station Manager to refund the amount lying with the authority as security deposit of agricultural connection.
3. Learned advocate representing WBSEDCL submits that RGRO could not have passed the said order as the Regulation in question was no longer in force and 2006 Regulation was in vogue.
4. The aforesaid submission of the licensee cannot be accepted. It is the statutory authority which passed the order in favour of the petitioner and the licensee never challenged or raised any objection to the same despite opportunity being granted. The said order is currently binding in between the parties.
5. Accordingly, the Station Manager being the respondent no.3 herein is directed to take steps to act in terms of the order passed by the Regional Grievance Redressal Officer and the Divisional Engineer (Electrical), Paschim Medinipur Range at the earliest and refund the temporary security deposit deposited by the petitioner for obtaining agricultural connection in accordance with law positively within a period of eight weeks from the date of communication of this order.
6. The writ petition stands disposed of.
7. Urgent certified photocopy of this order, if
applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
