Learned counsel appearing on behalf of the petitioners submits that till date the electricity connection has not been restored by the private respondents. The CESC Ltd. had made it clear that the electricity connection is on and is in live condition. It is the private respondent who is preventing the connection to be availed of by the present petitioners. This is despite the fact that the matter was taken up for hearing on 25.07.2023 and 21.09.2023.
Learned counsel appearing on behalf of the private respondent submits as follows. The private respondent is not coming in the way of restoration and supply of electricity to the petitioners. Moreover, the same ID and the bill no. that were referred to by the petitioners pertain to premises no.96/15 Cossipur Road.
At this stage, learned counsel for the CESC Ltd. clarifies the position and submits that initially the petitioners made an application with the address 96/15 Cossipur Road. Thereafter,
he prayed for necessary correction and the correction was effected. The actual address is 96/H/25/2 Cossipur Road. It appears that a fire had taken place at the said premises, which led to a disruption in the electricity supply. However, the electricity authorities have made it clear that supply is on and the connection is live.
In view of the above, the private respondents are directed to forthwith reconnect the electricity supply and/or cause it to be connected to the shop room of the present petitioners. This shall be ensured by the respondent police authorities. To make process simpler, the private respondent is directed to restore the electricity connection to the shop room of the petitioners by tomorrow. Today itself they shall give a notice to the fact to the Officer-in-Charge, Cossipore Police Station that the electricity connection is to be restored tomorrow. The police personnel deputed by the Officer-inCharge of the Cossipore Police Station shall remain present at the premises at the time of reconnection.
No further order need be passed in this regard. The respondent police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. With these observations, the writ petition is disposed of. Urgent certified copy of this order may be given to the parties expeditiously, if applied for.
