The revisional application was preferred challenging the order dated 22.12.2017 passed by the learned Judicial Magistrate, 7th Court, Howrah in connection with T.R. No.364 of 2017. The said order was challenged before the learned Additional Sessions Judge, Fast Track Court No.3, Howrah which was also not met with any success before the said court. The proceedings are under Section 46 A(c) of the Bengal Excise Act, 1909.

Mr. Ali, learned advocate appearing for the State has submitted photostat copies of the order dated 29.11.2021 which reflect that the petitioner has pleaded guilty before the learned Magistrate.

Photostat copies along with report filed by Mr. Ali in respect of the proceedings before the learned Judicial Magistrate, 7th Court, Howrah, be kept with the record.

The relief sought for in the present revisional application is in respect of return of the seized vehicle. In view of the fact that there are change of circumstances since the revisional application was preferred before this Court, I am of the opinion that the present revisional application has become infructuous. Accordingly CRR 2374 of 2018 is dismissed as infructuous.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
