None appears on behalf of the petitioner. The private opposite party no. 2 is enjoying the liberty of bail by virtue of an order passed by the Learned Additional Chief Judicial Magistrate, Alipore in a case under Sections 341/323/354/448/506/114/427 of the Indian Penal Code except the offence under Section 354 of Section 114 of the Indian Penal Code. All other offences are bailable in nature. Charge-sheet has been submitted in the instant case. In view of the absence of the Learned Advocate for the petitioner and considering the charge under which the opposite party no. 2 is liable to be tried, I do not find any reason for cancellation of bail of the opposite party.
