Learned counsel appearing on behalf of the petitioner submits as follows. The private respondents had been inflicting torture and assault on the present petitioner. This prompted the petitioner to approach the police station with a complaint. Finally Shyampukur Police Station Case No. 33 of 24.03.2022 was registered. However, no investigation was done. This prompted the petitioner to approach this Court alleging police inaction.
Learned counsel appearing on behalf of the State relies on the report and submits as follows. A charge-sheet has already been submitted in this case and an intimation has been given to the defacto-complainant. During investigation, statements of witnesses were recorded under Section 164 of the Code and notice was issued under Section 91 of the Code.
Learned counsel appearing on behalf of the private respondents denies the allegations and submits that they have always co-operated with the investigation. I have heard the submissions of the learned counsels appearing on behalf of the parties and have perused the writ petition and the report filed by the State.
It appears that the prime grievance of the petitioner about police inaction in the FIR lodged by her has already been redressed by the police authority. A charge has been submitted.
Therefore, there is no need to pass any further order. However, the police shall maintain sharp vigil at the
locale and ensure that no breach of peace take place. With these observations, the writ petition is disposed of.
